Comilmart Intellectual Property Policy

We are committed to protecting everyone's intellectual property and maintain this policy to explain how we address allegations of infringement, how authorized parties can report infringement regarding content on our platform, and how affected sellers can respond. We will remove material cited for alleged intellectual property infringement when provided with a report that complies with this policy. "Intellectual property" here means copyright, trademark, patent, and other intellectual property rights recognized by applicable law.
§1. Reporting Infringement
- To submit a notice of IP infringement, you must be the rights owner, or an agent authorized by the rights owner, to submit notices on their behalf.
- We will investigate listings or content upon receiving your report. Any report must be made in good faith and sworn under penalty of perjury.
- Reports should be submitted by contacting Comilmart support while logged in, through the IP infringement report portal ("IP Portal") once available, or via email and should include:
- Specific identification of the IP right you believe is infringed (registration number, description of the copyrighted work, link to the original work, first date of use/publication, etc.)
- The nature of the infringement (whether it appears on the product itself, physical packaging, product images, or listing text)
- A list of the infringing product listings (URLs)
- A list of the alleged infringer(s)
- Supporting documentation (e.g., order IDs for test purchases of the reported products)
- Your contact details (name, address, phone number, email)
- Any other information required under applicable law
- We may request additional information or verification before processing a report.
§2. Copyright Infringement Notices
If you own, or are authorized to act on behalf of the owner of, a copyright you believe is infringed, your notice through the IP Portal must include:
- The physical or electronic signature of a person authorized to act on behalf of the copyright owner
- Identification of each copyrighted work claimed to be infringed (a single notice may cover multiple works)
- Identification of each infringing item and information sufficient for us to locate it
- Your contact information (address, phone number, email)
- A statement that you have a good-faith belief the use complained of is not authorized by the copyright owner, its agent, or the law
- A representation that the information provided is accurate and that, under penalty of perjury, you are the copyright owner or authorized to act on their behalf
- Any other information required under applicable law
Misrepresentation warning: if you misrepresent that material is infringing, you may be liable for damages. If you're unsure whether material is actually infringing, please seek legal advice before submitting a notice.
If a notice is accepted, we will remove the reported content and take appropriate action against the responsible party. We do not share details of non-public actions taken.
Repeat infringer policy: Comilmart is committed to protecting intellectual property rights and will terminate accounts of repeat infringers in appropriate circumstances.
§3. Counter-Notices
If a Seller believes content that was removed (or disabled) is not infringing, or was used with proper authorization, they may submit a counter-notice including:
- A statement explaining why they believe a mistake, misidentification, or error was made
- Any other information or documentation required under applicable law
Upon receiving a valid counter-notice, Comilmart will take appropriate measures consistent with applicable law.
§4. Withdrawing a Report
A rights owner or authorized agent who submitted a report may withdraw it through the IP Portal. The withdrawal request must clearly identify the original report, including the complaining party's information, the IP right previously claimed to be infringed, and the specific material to be withdrawn from the report.
§5. False Notices
We may reject reports that we believe contain false, fraudulent, incomplete, or bad-faith information, and reserve the right to take action against anyone who abuses this policy. Repeated submission of inaccurate or fraudulent notices may result in removal of your ability to submit further reports.
§6. Related Policies
This policy works alongside Comilmart's Product Listing Policy and general Terms of Service (Section 14, Intellectual Property). For non-IP-related product concerns (e.g., counterfeit or unsafe goods generally), please use Comilmart's general Report Product feature instead.
